WARECOMM COMMERCIAL GENERAL TERMS AND CONDITIONS
Congratulations for using Warecomm products and services. These Commercial General Term and Conditions (hereinafter referred to as “Terms and Conditions”) are applied to all the products and services offered by Warecomm.
On using our products and services you also accept these Terms and Conditions. Thoroughly read these Terms and Conditions before you use our products and services.
1.- LIABILITY OR RESPONSIBILITY OF THE BUSINESS´S INTEGRATORS AND / OR PARTNER
The business´s Integrator and/or partner will be the sole responsible for any unappropriated or inadequate use of Warecomm products and services. The Integrator and/or business´s partner accepts to use the Warecomm products and services in accordance with the applicable laws and regulations.
2.- ADEQUATE USE
Warecomm products and services must be exclusively used for the purposes contemplated by the manufacturer. Any inadequate use, or any modification or alteration of the products and services of Warecomm without the expressed authorization of Warecomm will be prohibited and will be responsibility of the integrator and/or business´s partner.
3.- WARANTIES AND LIMITATIONS OF THE RESPONSIBILITY
Warecomm guaranties that its products and services complies with the specifications established in the attached documents. Nevertheless, Warecomm does not guarantee that its products and services be free from faults or errors and that will not be responsible for any loss or damage resulting from the use or the impossibility of using its products or services.
In any case, Warecomm will be responsible before the Integrator and / or business´s partner or before any third party for any loss, damage, responsibility, cost or expenses (including, but no limited to, direct or indirect damages, incidental, special punitive and consequential damages) arising from the use or impossibility of using the Warecomm its products and services, inclusive of Warecomm had been informed about the possibility of such losses, damages responsibilities, costs or expenses.
4.- COPYRIGHT
Warecomm products and services are protected by the copyright laws and exclusive propriety of Warecomm or its respectives owners. The Integrator and/or the business´s partner will not be able to copy, distribute, modify, sell or transfer any Warecomm´s product or services without the previous written consent of Warecomm or the corresponding owner.
5.- UP-DATINGS AND CHANGES
Warecomm keeps the right to amend these Terms and Conditions at any time and without any notice. Any change to these Terms and Conditions will be publish in our website. The Integrator and/or the business´s partner accepts that its is his responsibility to periodically review these Terms and Conditions and to be aware of any change.
6.- DISPUTES
Any dispute arisen from the use of Warecomm products and services will be solved by negotiating in good faith between the parties. Should the parties does not reach to an agreement, the dispute will be solved by binding arbitration according to the applicable Laws. The Integrator and/or the business partner who accepts.
